This course assumes no prior knowledge in law, business or engineering. However, students with backgrounds in all three areas will find useful concepts or ideas in the course on how to protect business innovations using patents. The approach taken in this course is practical and commercial rather than theoretical. A combination of lectures and case studies help to illustrate the concepts and make the course more interesting.

After completing this course, students should be able to understand how patents are issued and protect innovations, including: What is a patent? What do they protect? How do we get a patent? Where are patents valid? How much do they cost?

In addition to basic concepts the course also deals with advanced topics such as: software patents, business process patents, patenting life, patent trolls and multiple case examples of large and small companies using patents and patent lawsuits.

Syllabus

  • Introduction to Patents
    • Welcome to Protecting Business Innovations via Patents! Why are patents so important? You will learn about the basics of patents and how they are useful in protecting innovation as well as some of the limitations and costs of patents. This first module allows you to "survey the buffet". Before you start your survey of Patents, take some time to review the assignments, grading and general course guidelines for this course. Also, don't forget to introduce yourself and say hello to your fellow learners.
  • PROCESS OF GETTING A PATENT
    • This week we will look at the process of getting a patent in terms of the time, cost and effort required for each step of the patenting process. Here's where you plan your assault on the buffet.
  • UTILITY PATENT REQUIREMENTS
    • We get down to the details on what is needed to submit a formal patent application including providing evidence regarding novelty, utility and non-obviousness. Let's dig in to the main meal.
  • ADVANCED PATENT TOPICS
    • You left room for dessert right? In this week we learn about patent trolls, software patents, business process patents, patenting life and case examples of large and small companies using and going to court over patents.
  • Putting your knowledge to work
    • Instead of an exam, we are going to have you apply your newfound knowledge to evaluate an actual patent case that went to court. All of the knowledge gained and discussions from Weeks 1-4 will help you

    It was great time learning this course. Through this I was able to gain knowledge about the real business world, the patenting techniques etc. So hope that this knowledge would be of great use to me in the near future.     Thank you for the amazing course. I have just finished the last lecture.
    This cours is a must have for any graduate student out there. I found that without having this course and for the scarcity of details we had previously about patents, We publish a lot of journal articles for free for products we could have patented otherwise for big profit.
    This course will expand your research business model beyond the simple raise fund>do research>publish for free.
    It will equip you with a new option of doing research>getting patent>licensing others for big profits> fund more research.
    This was a great course with an outstanding professor.

    This is a great course taught by a great professor. It provides a very comprehensive framework and starting point for those interested in how the world of IP Law works. Very good examples along the course and fluent, in an accessible vocabulary. My only regret is that HKUST doesn't provide a full 2-3 years certified online IP Law class, resulting in a full JD Law degree, perhaps combined with international business (and international patent laws). Thank you!

The instructor starts with an appetizing video, followed by series of courses to explain and end with some case studies. I find it useful to look deeper into patents as an IT student, I think it is also important for students from many disciplines to learn this course. Thanks for providing this course!

    I thoroughly enjoyed this course because Prof. Clark broke it down into easily digestible bits. I have somehow had this irrational fear of IP and I think that has reduced a bit! I am all set now, to try my hand at writing my first rough IP draft. It is so very different from writing a paper for a scientific journal!

    Terrific overview on the complex world of patents. Professor was engaging. I didn't enjoy the peer review assignment on software patents, because that's not a specialty I'm interested in, but others may disagree. I feel I learned the language and basics and my next step is to begin drafting provisional patent.
